On June 12, 2018, U.S. Customs and Border Protection (CBP) has published in the Federal Register the Interim Final Rule on the Air Cargo Advanced Screening (ACAS) program. The long awaited interim rule amends its regulation on advanced electronic data filing - making it mandatory in what was voluntary under the ACAS pilot program. Other requirements are detailed in the notice. Here is a summary of ACAS changes to CBP requirements:
Timing of Data Submission
As early as practicable, but no later than prior to loading of the cargo onto the aircraft. No changes to the timing of 19 CFR 122.48a requirements.
Data
Six mandatory data elements (subset of 19 CFR 122.48a data elements and same as ACAS pilot) at the lowest air waybill level, plus one conditional and optional data element. The following are mandatory:
Eligible Filers
Inbound air carriers, other filers eligible under 19 CFR 122.48a (which includes an importer or its Customs brokers as identified by its ABI filer codes), and freight forwarders.

The final rule allows for a year-long phased implementation. Comments to CBP are due by August 13, 2018.
